Building Over or Near to Council Infrastructure
Class 1 & 10 Structures
Building work over or near to Council infrastructure such as sewers, water mains or stormwater drains must be assessed against the Queensland Development Code Part MP 1.4 – Building over or near relevant infrastructure. The purpose of this is to ensure building work of a structure on a lot that contains, or is adjacent to a lot that contains relevant infrastructure is carried out, so the work does not:
- Adversely affect the operation of the infrastructure; or
- Place a load on the infrastructure that could adversely affect its structure
The QDC Part MP 1.4 consists of specific requirements and standards across Queensland to ensure the proposed building works complies with the acceptable solutions. However, if the proposed work does not comply with the acceptable solutions, a referral to the relevant concurrence agency, in this case Gladstone Regional Council, for assessment is required in accordance with Council’s Building over or near Council Infrastructure Policy (P-2023-11).

Alternate Solutions
Where the proposed building works is referred to Council due to non-compliance with the QDC Part MP 1.4 Acceptable Solutions (A1 and A2), an application form and fee will be applicable as part of that application. The applicant will need to demonstrate how they can comply with the relevant QDC Part MP 1.4 Performance Requirements (P1 and P2). A referral to Council that does not comply with the Acceptable Solutions (A1 or A2) will be assessed on an individual basis and Council reserves the right to refuse any application that does not meet the Performance Requirements in the QDC Part MP 1.4.
Note:
a. There are no acceptable solutions (A1 and A2) for Class 1 or 10 structures where the:
- Sewer mains are greater than 225mm in diameter; or
- Stormwater mains are greater than 375mm in diameter; or
- Infrastructure is a pressure pipeline; or
- Are within 3m of the infrastructure and the infrastructure is not 300mm above the zone of influence of the footings.
Therefore, an application will need to be submitted to Council for assessment.
b. There are no acceptable solutions (A1 and A2) for building works for a class 2,3,4,5,6,7,8 or 9 and this will automatically require an application to be submitted to Council as a concurrency referral agency.

Referral application NOT required if the below are met
(as per QDC Part MP 1.4 Acceptable Solutions A1 and A2)
If any of the below criteria cannot be met, an application to Council is required.
Note: Private Certifiers are required to provide the applicable sewerage service provider, in this case Gladstone Regional Council a Form 32 along with the applicable Building Application where QDC Part MP 1.4 applies.
Building Over or Near to Council Infrastructure
A wall, footing, pile pier or floor of the structure:
- Is installed at least 1.5m distance from centre of manhole
- Is installed at least 1.2m from Council infrastructure
- Is a 3m distance from the infrastructure for sewer mains greater than 225mm in diameter and stormwater mains greater than 375mm in diameter
- The invert level of the council infrastructure is at least 300mm above the point of the zone of influence
- Is installed at least 1m clear of all parts of connection points at finished surface level and at least 2.4m height clearance – measured from the finished surface level e.g. slab).
Building Over or Near to Council Infrastructure
The structure can be built when:
- All the walls, columns and roofs of the building or structure are constructed from materials other than concrete and masonry
- If a lightweight structure complies with AS 1684 or AS 2870 or is certified by an RPEQ as compliant with QDC Part MP 1.4 P1
- Is installed at least 1m clear of all parts of connection points at finished surface level and at least 2.4m height clearance – measured from the finished surface level e.g. slab)
- Is a 3m distance from the infrastructure for sewer mains greater than 225mm in diameter and stormwater mains greater than 375mm in diameter
- Not more than 10m in length exceeds continuously over the infrastructure.
Building Over or Near to Council Infrastructure
If the fence is more than 2m high, retaining wall more the 1m high:
- The design of the wall must be certified by an RPEQ as compliant
- Is installed at least 1.5m distance from centre of manhole
- Is installed at least 1.2m distance from Council infrastructure
- Is a 3m distance from the infrastructure for sewer mains greater than 225mm in diameter and stormwater mains greater than 375mm in diameter
- The invert level of the council infrastructure is at least 300mm above the point of the zone of influence
- Is installed at least 1m clear of all parts of connection points at finished surface level and at least 2.4m height clearance – measured from the finished surface level e.g. slab).

Alternative Solutions where an Acceptable Solution (A1 and A2) cannot be achieved
Referral Application IS required (P1 and P2 performance criteria must be met)
Whilst Council will assess each application for an Alternative Solution based on the individual development proposal, some guidance is provided below for Alternative Solutions that may or may not be accepted.
Minimum Application Submission Requirements – if acceptable solutions (A1 and A2) cannot be met.
When applying for assessment against the QDC Part MP 1.4 Performance Requirements (P1 and P2), to demonstrate compliance the following table outlines the minimum requirements to be submitted in addition to the application form and fees.
- Lightweight structures - Provide a Form 15 from a qualified professional (RPEQ) that the proposed structure complies with the lightweight structure requirements set out in QDC Part MP 1.4
- Non-Lightweight Structures - Provide a Form 15 from a qualified professional (RPEQ) that the proposed structure complies with the requirements set out in QDC Part MP 1.4 and does not impose any loading on the infrastructure.
- Pre works CCTV Inspections of Council Infrastructure that is impacted.
Note: Council will undertake the CCTV inspections on written request from the applicant and applicable fee paid. Should the application be approved, post works CCTV will also be required to be submitted. - Proposed drawings showing correct location of Council infrastructure and proposed location of buildings/structures or proposed extent of Fill or Excavation works.
- Provide engineering designed drawings including footing details.
- Provide the site plans that have been drawn to scale and with dimensions.
Checklist - for proposed alternative solutions
☐ Engage a Registered Professional Engineer of Queensland (RPEQ) to design and certify the structure
☐ Obtain a copy of the certified engineer design
☐ Site plan that has been drawn to scale and with dimensions (measurements) that shows the details of the structure location, size, design and distance from all structures and infrastructure
☐ Complies with the QDC Part MP 1.4 acceptable solutions (A1 and A2) – No Build over Sewer or Adjacent to Infrastructure application required
☐ Does not comply with the QDC Part MP 1.4 acceptable solutions (A1 and A2) – A Build over Sewer or Adjacent to Infrastructure application is required
☐ CCTV inspection report – if application required
☐ Completed Application Form and fees – if application required.
